Tort reform, anyone?

The woman who claimed that she found a human finger in her chili at a Wendy's restaurant has been arrested. An article about that situation notes that this person has been involved in nearly a dozen litigation squabbles over the years concerning various matters before getting caught here. A DOZEN!

All I can say is that the Republican Party really needs to expand upon the "Contract with America" to further curtail lawsuit abuse...

Dude,

I am not so sure that tort reform is needed. After reading the article in the advocate, I think what is really needed is prosecution of false claims. Throw the bums in jail if they are found of wrong doing in search of a lawsuit.

Some of the stories I have heard concerning lawsuits is.....

A lady who injured her wrist at work sued the company for workmans comp. She was working for a phonesex company and injured her wrist while masterbating.

A man sued his neighbor because the dog bit him. He would have gotten more but the jury felt that he was partly to blame because he was in his neighbor's yard when he threw rocks at the dog.

In Denham Springs, a woman filed a lawsuit against Nintendo of America because during game play, her son would sometimes have convulsions. During the sixth convulsion, he hit his head and died. Her son was thirty years old at the time of his death and played Nintendo 8 hours a day seven days a week. Nintendo also has a disclaimer in the owners manual advising the owner to cease using the Nintendo and consult a doctor if game play causes dizziness or convulsions.

A California woman sued the city of Los Angelos because the bus didn't stop exactly where is was supposed to. The bus travelled a couple of feet to far and according to her claim, altered her chemical balance causing her to become a nymphomaniac.

Anyone care to join in the chorus with your own frivilous lawsuit?

Our courts are heavily clogged with such cases. We must do something to limit these now.

Yeah, but many claims are hard to prove "false". Sure, in the case of the finger-in-the-chili matter, there was a finger that could be tested to see if it was in the chili before or after cooked. But many times people files claims over much more intangilble things like "mental trauma" caused by an experience. How can mental trauma be proved true or false when only the claimant truly knows if they were traumatized or not. Juries often reward such claimants with millions of dollars. Many companies will just settle out of court to avoid the negative publicity caused by the case--but it still costs them thousands or even millions of dollars to do so.
